REVIEW MACMAMP.NO.435 of 2010 in MACMA.No.428 OF 2005

ORDER:

Heard the learned counsel for the revision petitioner and the learned counsel for the 1[st] respondent.

This petition is filed to review the order of this Court dated 22.10.2010 passed an MACMA.No.428 of 2005 which was filed against the Judgement and decree in O.P.No.331 of 2002 dated 17.11.2004 on the file of Motor Accidents Claims Tribunal, East Godavari at Rajahmundry.

The claim is made by the pillion rider of the insured vehicle. The claim was allowed. Having aggrieved by the same, the Insurance Company preferred an appeal contending that there is no liability for the Insurance Company against the pillion rider. Since the policy issued in this matter is a simple Act policy and not even a comprehensive policy. However, the contention of the Insurance Company was rejected and appeal was dismissed by the impugned order dated 22.10.2010.

When this review petition is taken up for hearing, learned counsel for the review petitioner has fairly submitted that it is not a case fit for review since the matter was disposed of on merits.

In view of the same, the petition is dismissed.
