ORAL JUDGEMENT
Rule. Mr. B.A.Vaishnav, learned advocate waives service of rule for respondent. By consent, the petition is finally disposed of today.
In the departmental proceedings, the
respondent-Conductor was awarded the punishment of reduction of 10 stages. The Industrial Tribunal has set aside the punishment on the ground that it was excessive and disproportionate and has awarded the punishment of stoppage of two increments with permanent effect.
Having heard submissions made by the learned advocates for the parties, I am of the opinion that the punishment of stoppage of five increments with permanent effect will meet the ends of justice in the facts and circumstances of the case. The award of the Industrial Tribunal stands modified accordingly. Rule made absolute accordingly. No order as to costs.
