THE HON’BLE SRI JUSTICE NINALA JAYASURYA WRIT PETITION No.24518 OF 2020

ORDER:

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Land Acquisition.

2. At the time of hearing, the learned Assistant Government Pleader for Land Acquisition on instructions states that no Special Leave Petition has been preferred against the orders of the Division Bench in A.S.No.666/2004, dated 27.04.2018.

3. In view of the same, this Court is inclined to dispose of the Writ Petition as the subject matter of this Writ Petition is squarely covered by the order dated 07.09.2020 passed in W.P.No.15799 of 2020 by this Court.

4. This is a matter where the petitioners’ lands were acquired in the year 1990 and the compensation has not been paid even after the matter has attained finality. This Court finds no justification on the part of the respondents in depriving the petitioners’ fruits of the orders passed in their favour due to administrative delays.

5. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners and learned Government Pleader for Land Acquisition, the respondents are directed to deposit/pay the compensation in respect of the lands acquired from the petitioners, within a period of four (4) weeks from the date of receipt of copy of the order.

6. With the above direction, this Writ Petition is disposed of. No costs. Registry is directed to attach a copy of the order in W.P.No.15779 of 2020 dated 07.09.2020 to this order.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
