For the Petitioner: Mr. Manoj Kumar Sah, AdvocateFor the State : APP.----- 03/28.04.2014.Having regard to the allegation made in the first information report wherein allegation has been made that the petitioner did cause miscarriage of the deceased, resulting into her death, I do not find any illegality with the order dated 12.12.2011 passed in Poraiyahat P.S. Case No.115 of 2011 (G.R. No.785 of 2011) whereby cognizance of the offence under Section 314 of the Indian Penal Code has been taken against the petitioner and, thereby, order taking cognizance dated 12.12.2011 never warrants to be quashed.

Accordingly, this application stands dismissed.

Notwithstanding the fact that this application got dismissed, the petitioner would be at liberty to raise all the points, which have been raised in this application at the time of discharge.
