The petitioner was reverted to Class-IV post from that of post of Ganak, Class-III post by the impugned order dated 26.11.1999 issued by the respondent no. 4, the Regional Director, Department of Animal Husbandry, South Chotanagpur Range, Ranchi.
According to the petitioner, the said promotion was given vide order dated 28.01.1986, Annexure-1, by the same authority after considering qualification of the petitioner being matriculate upon recommendation of the Establishment Committee as well. It is submitted that the matter was transferred from Patna High Court and there is an interim order dated 16.02.2000 staying the impugned orders. The petitioner has, in the meantime, retired on 30.09.2012 and his post retirement benefits are being withheld on account of pendency of the writ petition.
From perusal of the records, it, however, appears that no counter affidavit has been filed in the matter though it has been remained pending for last 14 years. Therefore, on the request of the learned counsel for the respondents, one more opportunity is allowed. It is made clear that the case will not be adjourned further for the same purpose.
Accordingly, let the case appear after four weeks.
Let a copy of this order be handed over to the learned counsel for the respondents.
