ORAL JUDGEMENT

Both the counsel for the parties are in agreement that this writ petition may be disposed of in terms of the order passed by this court in Special Civil Application No.3724 of 1981 and cognate matters.

In para no.16-A of this Special Civil Application, the petitioner has stated that the Special Civil Applications no.3724/81, 2459/82 and 4170/82 on similar points have been admitted by this court and interim relief is granted. On 9-5-1984 this court has made the order in this case, "Rule. Ad-interim relief in terms of para 18(c). To be heard along with Sp. C.A. 3724/81 and others."

This Special Civil Application was the cognate matter of aforesaid Special Civil Applications which have been decided under the order of this court dated 20th February, 1991 and this Special Civil Application would have been left out. In view of this fact, the prayer made by the counsel for the parties deserves acceptance.

In the result, this writ petition is disposed of with the direction to the respondent-Corporation and its officers not to evict the petitioners from the land in question except in accordance with law, and to give them the benefit of resolution dated 17th August, 1986 if they are entitled for the same. Rule is made absolute in the aforesaid terms with no order as to costs.
