IN THE HIGH COURT OF JHARKHAND AT RANCHI W. P. (S) No. 2898 of 2003

Karamdeo Yadav...... ..... Petitioner

VersusCentral Coalfields Limited & others ......Respondents. -----CORAM: HON’BLE MR. JUSTICE APARESH KUMAR SINGH-----For the Petitioner : None. For the Respondents : M/s. Ananda Sen & Kaustav Panda, Advs.

CORAM: HON’BLE MR. JUSTICE APARESH KUMAR SINGH

-----

No one appears on behalf of the petitioner.

9/4.09.2014

This writ application was dismissed twice for non-prosecution earlier and restored thereafter. Still there is no representation on behalf of the petitioner when the matter is taken up today.

Learned counsel for the respondents are present and pointed out that a dispute relating to date of birth has been raisedat the fag end of the career of the petitioner. As per official records, the petitioner's date of birth is 6th February, 1944and on his representation made earlier in the year 1983 itself the issue was settled after the order was passed by the Staff Officers (Personnel) Central Coalfields Ltd. (N. K.) Dakra Area on 12th October, 1993. The said order has not been challenged by the writ petitioner though it has been filed in the year 2003 after 10 years from passing of the said order.

Having regard to the aforesaid facts and circumstances, it appears that on the one hand the dispute of date of birth has been raised at the fag end of the petitioner's career, more so when the same issue was already decided by the order of the respondents in October, 1993 itself and has remained unchallenged thereafter, there is a lack of interest shown by the petitioner in pursuing the application which has been dismissed twice earlier for non-prosecution. Therefore, the writ petition is dismissed.
