CORAM: HON'BLE MR. JUSTICE SHREE CHANDRASHEKHAR

For the Petitioner : NoneFor the Opposite Parties: J.C. to A.G.-------------- 14/26.08.2015 This application has been filed seeking initiation of proceeding under the Contempt of Courts Act, 1971 for willful disobedience of order dated 24.06.2008 in W.P.(C) No. 4998 of 2007.

This contempt petition was filed on 18.05.2011. Section 20 of the Contempt of Courts Act, 1971 provides limitation of one year from the date, the cause of action Satyarthi/- arises. In the present application, the applicant has averred that order dated 26.06.2008 was served upon opposite party nos. 3, 4 & 5 on 29.03.2011 and 31.03.2011. Merely because a copy of order has been served about three years after the order passed in the writ petition, it would not create a fresh cause of action. Accordingly, the present application is dismissed.

(Shree Chandrashekhar, J.)
