...

CORAM: HON’BLE MR. JUSTICE PRASHANT KUMAR.

…

For the Petitioner : Mr. A.K. Chaturvedi, Advocate. For the State: Mr. Hardeo Pd. Singh, A.P.P.…

Bail application filed by Umar Ansari, is moved by Sri. A.K. Chaturvedi, learned counsel for the petitioner and opposed by Sri. Hardeo Prasad Singh, learned Additional P.P. for the State.

This is a case under Section 304(B) of the I.P.C. and Section 3 / 4 of the Dowry Prohibition Act. It appears that the informant (father of deceased) and his wife namely Jaipul Khatoon had already been examined in the court below as P.W.-2 & 3. They have not supported the case of prosecution and declared hostile.

Considering the aforesaid facts and circumstances, I allow this application and direct the court below to enlarge the petitioner on bail on his furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1[st] Class, Hazaribagh, in connection with Bishnugarh P.S. Case No. 001 of 2014 corresponding to G.R. No. 02 of 2014.
