Issue notice to the opposite party for final hearing of this application by registered post with A/D as well as under ordinary process requisites etc. must be filed within one week, failing which this application shall stand rejected without further reference to the Bench.

Operation of the impugned order dated 30.09.2010 passed in M.P. Case Non 52 of 2004 shall remain stayed, subject to the condition that the petitioner will deposit a sum of Rs. 1,000/- (one thousand) in the Court below by 10[th] day of each succeeding month from the month of March 2013. If he fails to deposit the aforesaid amount in the Court below the stay order stands automatically vacated.

The O.P. No.1 will be at liberty to withdraw the said amount from the Court below.
