CORAM : HON’BLE MR. JUSTICE H. C. MISHRA

------For the Petitioners:Mrs. Rashmi Kumari, AdvocateFor the State :A.P.P.------ 2/ 23.12.2014

Heard learned counsel for the petitioner and learned counsel for the State.

This criminal miscellaneous petition has been filed for modification of order dated 27.11.2014 passed in A.B.A. No. 3301 of 2014.

In the last paragraph of that order, it has been stated that 'if the petitioners surrender and pray for regular bail in the Court below, the Court below shall dispose of the same in accordance with law, taking into consideration the fact that the some of the co-accused persons have already been granted anticipatory bail in this case'.

It is submitted by learned counsel that co-accused were actually granted regular bail and not anticipatory bail, but they were granted regular bail on the same day.

The order dated 27.11.2014 passed in A.B.A. No. 3301 of 2014 clearly shows that the order was passed on the basis of submission of learned counsel for the petitioners. As such, there is no scope of any modification in the said order.

This criminal miscellaneous petition stands dismissed.
