IN THE HIGH COURT OF JHARKHAND AT RANCHI

B. A. No. 11409 of 2013

Dharambeer Sao ……PetitionerVersusThe State of Jharkhand ……Opp. Party----- CORAM: HON’BLE MR. JUSTICE R.R. PRASAD

-----

For the Petitioner: Mrs. J. Tripathy, AdvocateFor the State: A.P.P.

-----

2/20.12.2013Heard learned counsel appearing for the petitioner and learned A.P.P. appearing for the State.

The petitioner is an accused in a case instituted under Section 304B of Indian Penal Code.

Learned counsel appearing for the petitioner submits that prayer for bail of the petitioner was rejected twice by this Court but there has been reason on the part of the petitioner to move to this Court for reconsideration of prayer for bail, as earlier on 17.8.2013 when prayer for bail was rejected, liberty was granted to him to renew his prayer for bail if the trial is not concluded within three months and that three months was stipulated, keeping in view the report submitted by the trial court that the trial would be concluded within three months still there is no likelihood of early conclusion of trial in near future and therefore the petitioner be admitted to bail as he has been in custody since 6.1.2010.

In view of the facts and circumstances of the case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Hazaribagh in S.T. No. 176 of 2010 on the condition that the petitioner will appear before the court below on each and every date failing which his bail bond would be liable to be cancelled.
