RFA 56/2000

BEFORE

HON’BLE MR. JUSTICE U. B. SAHA

It appears that the appellant is not interest for the present proceedings. It also appears from the office note dated 01.08.2006 and the Lawazima Court order dated 20.06.1988 that no steps have been taken by the learned Advocate to rectify the defects and not only that as per the report of the Stamp Reporter and the order of the Lawazima Court, the learned Advocate need to file Deficit Court Fee of Rs. 1913.10 and the certified copy of the decree. But no steps have been takenfor correcting the defects as stated above.

When the matter is called on, none appears and even there is no prayer for adjournment. In this situation, there is no other alternative being the appeal is defective one; it would be proper for this court to dismiss the matter for non-prosecution.

Accordingly, the instant appeal is dismissed for non-prosecution.
