WP(C) 5587/2006

BEFORE

THE HON’BLE MR JUSTICE A H SAIKIA

Heard the learned counsel for the parties.

In this writ petition, the petitioner has challenged the order dated 18.9.06 by which the competent authority floated the impugned Notice Inviting Tender ( for short,’NIT’) for the year 2006-07 to 2012-13 on expiry of the previous terms of settlement with the petitioner for the period from 1.4.01 to 31.3.06.

It is contended that the representations dated 1.3.06 and 31.3.06 submitted by the petitioner seeking extension of the leave period on its expiry on 31.3.06 were not considered by the authority concerned.

On close perusal of the impugned order and materials available on records, it transpires that this Court by order dated 5.6.06 passed in W.P. ( C) No.2808/06 directed the respondents to consider and dispose of both the representations abovementioned in the light of a case reported in 2001 (1) GLT-454.Having regard to the order dated 5.6.06 and also upon overall consideration of the facts and circumstances of the case including prayer for extension of the lease period after the expiry of the same, I do not find any plausible or cogent reason to interfere with the same.

This writ petition stands dismissed.
