Crl.A. 144/2005B E F O R E

THE HON’BLE MR. JUSTICE AMITAVA ROYTHE HON’BLE MRS JUSTICE ANIMA HAZARIKA

As the prayer made in the instant interim application in essence is one for clarification of the sentence awarded by the judgment and order dated 21.12.2006 rendered by the Division Bench comprising Hon’ble Mr. Justice D Biswas (as he was then) and Hon’ble Mrs. Justice Anima Hazarika, the Registry would apprisethis Bench as to whether it would procedurally be permissible for it (this Bench) to deal with the prayer in absence of the endorsement of the matter to it by Hon’ble the Chief Justice.

The learned counsel for the parties would also apprise this Court of thepower under the relevant provision of law to award a sentence of imprisonment in lieu of sentence of fine or in default on the part of the convict to deposit the same.
