Gauhati High Court

WRIT PETITION 4188/2010 on 22 June 1994

WP(C) 4188/2010BEFORE

THE HON’BLE MR. JUSTICE A.C. UPADHAYAY

Heard Mr. Mr. M. Mollik, learned counsel appearing for the petitioner and Mr. J.Abedin, learned Standing Counsel, Education Department.

The petitioner is before this Court for non payment of her arrear salaryas well as current salary though she claims to have been duly appointed as a Grade-IV employee in Baguan Girls High School, Goalpara on 22.6.1994 by the Headmaster & Secretary of the said school as per the resolution of the Managing Committee of the school. Thereafter, the Inspector of Schools, Goalpara District Circle, Goalpara vide his order dated 17.6.2003 adjusted the service of the petitioner against a regular vacancy. Though thereafter the petitioner got her salary upto the month of November, 2003, her salary since the month of December, 2003 has not been paid.

It is submitted at the Bar that the issue involved is covered by the decision of this Court rendered in Sudhendu Mohan Talukdar & Ors, petitioners V. The State of Assam and anr, respondents, reported in (2006) 2 GLT 216 wherein similar claims have been referred to the Committee constituted thereunder for scrutiny and necessary action.

Having regard to the pleaded facts, I do not consider that a different approach is necessary in the instant case.

The petition is therefore closed with a direction that the petitioner would submit representation before the Committee constituted by this Court in the aforementioned decision and if it is so done, it (committee) would deal with the issue in terms of the directions contained in the aforementioned decision. The petition stands closed in the above terms. No costs.
