Heard Ms. M Bora, learned Government Advocate, Arunachal Pradesh/review petitioner and Mr. AS Bhattacharjee, Senior Advocate assisted by Mr. K Paul, Advocate for the respondent.

The grounds seeking a review of the judgment and order dated 23.12.2008 passed in WP(C) No. 6739/2004, are by way of reiteration of the stand taken by the respondents in their affidavit, on a consideration whereof, the aforementioned writ proceeding has been disposed of on merit. Though, it has been brought on record that by order dated 22.12.2008 passed by the Deputy Inspector General of Police (W), Arunachal Pradesh, the penalty of removal of the petitioner from service, had been confirmed thereby, in the disciplinary proceeding referred to therein, in the opinion of this Court, the same cannot constitute a ground for review.

In the above view of the matter, this petition stands rejected.
