Versus

SAKARLAL GOKULDAS RANA

-------------------------------------------------------------- Appearance:

1. Special Civil Application No. 14197 of 1993 MR PC MASTER for Petitioner No. 1 MR AG VYAS for Respondent No. 1

-------------------------------------------------------------- CORAM : HON'BLE MR.JUSTICE H.K.RATHOD

Date of decision: 18/12/2003

ORAL JUDGEMENT

Heard learned advocate Mr. P.C.Master for petitioner and learned advocate Mr. A.G.Vyas appearing on behalf of respondent.

2. When the matter has been taken up for hearing Mr. P.C.Master submitted that inspite of repeated letters served to the petitioner no response is received by him from the petitioner and, according to his information petitioner is already died and legal heirs have not been brought on record in time and they were also not come forward with a request to join them as party in place of the petitioner who died. He, therefore, submitted that this matter can be disposed of as having become infructuous.

3. In view of the above fact, according to my opinion Mr. Master is right to submit that this petition has become infructuous. Accordingly, present petition is disposed as having become infructuous. Rule is discharged. Interim relief, if any, stands vacated.
