THE HON’BLE MR JUSTICE B.P. KATAKEY

Heard Mr. Upadhyay, learned counsel for the petitioner as well as Mr. Sarma, learned standing counsel, appearing for the respondents. The petitioner by the present petition has challenged the order of transfer dated 23.11.2011 transferring him from Gohpur to Dhekiajuli. According to the petitioner, he was earlier posted in Nagaon and pursuant to the order of transfer dated 28.01.2011 he was transferred from Nagaon to Gohpur and accordingly he joined his transferred place of posting. It is the case of the petitioner that within 10 months from the date of joining at Gohpur, he has again been transferred vide order dated 23.11.2011.

It appears that the petitioner being aggrieved by the said order dated 23.11.2011 filed a representation before the Assistant Executive Engineer on 29.11.2011 and not even before the General Manager, who has passed this order. In view of the above, the writ petition is disposed of giving liberty to the petitioner to approach the Chief General Manager( Distribution), APDCL,(CAZ), Bijulee Bhawan, Guwahati, ventilating his grievances relating to transfer and if such representation is made, the same shall be disposed of within a period 1(one) week from the date of making such representation. The writ petition is accordingly disposed of.
