THE HON’BLE MR. JUSTICE B.K. SHARMA

None appears for the petitioner on call. On verification of the records, it appears that the writ petition was disposed by order dated 11.5.2006.

The instant application was filed on 25.9.2007 for a direction to the respondents to pay arrear salary in terms of the above order dated 11.5.2006. Thus by filing of the instant application, the petitioner seeking implementation of the aforesaid order dated 11.5.2006.

I am of the considered opinion that once the writ petition was disposed of finally by the aforesaid order dated 11.5.2006 with the particular direction; same direction cannot be reiterated by reopening the writ petition on the basis of a miscellaneous application. If the petitioner feels that there is any violation of the aforesaid order dated 11.5.2006, it will be open for him to initiate appropriate proceeding.

With the above observation, Misc. Case stands disposed of.
