Heard learned counsel for the petitioner and Mr.P.Konwar, learned Addl. Public Prosecutor, Assam.

By filing this 2nd bail application under Section 438 Cr.P.C., the accused /petitioner Sri Pran Gupta, apprehending arrest in connection with Nagaon Sadar P.S.Case No.1679/2014 U/S 302/325/34 IPC is praying for bail. The new ground assigned in this second bail application that the accused petitioner being only the neigbour he has been implicated. Earlier while rejecting the bail application the petitioner was found directly involved and the allegation of the case is U/S 302 IPC along with other allied sections. There being no new ground that the petitioner can hamarred for the factual position that has been already in the case diary, prayer cannot be allowed. In view of the above, this A B stands dismissed.
