WP(C) 6527/2011BEFOREHON’BLE MR JUSTICE B. K.SHARMA

Heard Mr M. Dutta, learned counsel for the petitioner as well as Mr MR Pathak, learned Standing Counsel for the education department.

As agreed to by learned counsel for the parties, the matter is taken up for disposal at the motion stage itself.

Without expressing any opinion on the merits of the case of the rival parties, I dispose of this writ petition providing that the respondents may examine the case of the petitioner in terms of the guidelines formulated in Achyut Ranjan Das vs. State of Assam and others, reported in 2006 (4) GLT 674, and the judgment dated 2.7.2010 passed in a batch of writ petitions, the lead case being WP(C) no.2620/ 2009 (Faziron Nessa vs. State of Assam and others). Needless to say, the petitioner cannot claim consideration of his case against any particular post or service, and the consideration will be strictly as per the parameters andyardsticks laid down in the guidelines.

The writ petition stands disposed of.
