MC 1723/2013

BEFORE

HON’BLE MR. JUSTICE B.P. KATAKEY

Heard Mr. K.K. Mahanta, learned counsel for the applicant and Mr. N. Das, learned counsel appearing for the respondent Nos.1 to 3. The applicant by the present application is seeking condonation of delay of 21 days occurred in preferring the appeal on the ground stated in the application. The prayer for condonation of delay has been opposed by the learned counsel appearing for the respondents.

Having heard the learned counsel appearing for the parties and upon perusal of the averments made in the application, I am of the view that the applicant was prevented by sufficient cause in not preferring the appeal in time and hence, the delay of 21 days occurred in filing the appeal is condoned. Misc. Case stands allowed.
