WP(C) 6815/2010BEFORE

THE HON’BLE MR JUSTICE IA ANSARI

Heard Mr. H. Sharma, learned counsel for the petitioners, and Mr. BJ Ghosh, learned Government Advocate, Assam, appearing on behalf of respondent Nos.1 to 5.The basic grievance of the petitioners is that while making the selection of beneficiaries under Mukhya Mantrir Anna Suraksha Yojana, the respondents/authorities concerned had not abided by the guidelines and directions, which have been issued, in this regard, by the appropriate authority and the select list, as a result of the illegalities so committed, is bereft of the authority of law. According to the petitioners, though being eligible, they have illegally not been included in the list of beneficiaries.

Considering the matter in its entirety and in the interest of justice, it is hereby directed that the respondents, particularly, the respondent No.3, shall examine the grievances of the petitioners and pass necessary order(s) in accordance with law. The whole exercise, so directed, shall be completed within a period ofone month from the date of receipt of a copy of this order by the respondent No.3.

Whatever decision is taken by the respondents, particularly, respondent No.3, onexamination of the matter, as directed hereinbefore, the same shall be communicated, in writing, to the petitioners. If the petitioners feel aggrieved by the decision(s), which may be arrived at by the respondents/ authorities concerned, or by the order(s), which may be passed by respondents/authorities concerned, they shall remain at liberty to take further remedial measures as may be available to them.

The petitioners may furnish to the respondent No.3 a certified copy of this order along with a copy of the writ petition and annexures thereto. The writ petition shall stand disposed of in terms of the above directions.
