MC 1159/2015

BEFORE

HON’BLE MR. JUSTICE KALYAN RAI SURANA

Heard Ms. R Sarma, learned counsel for the applicant and Mrs. NS Tahkuria, learned counsel for the respondent Nos. 6 & 7. None appears for the respondent Nos. 1 & 5.

As per order dated 5.12.2016, none has entered appearance for the respondent Nos. 1 & 5 and accordingly, the matter is proceeded ex-parte against them today.

Mrs. Thakuria, learned counsel for the respondent Nos. 6 & 7 submits that she has no serious objection on the grounds taken for condonation of delay of 61 days.

On perusal of the averments made in this application, it appears that official procedure requiring the filing of the appeal, had consumed the time and therefore, this Court finds that there are sufficient grounds for condoning the delay of 61 days in preferring the connected appeal. Consequently, the delay of 61 days is hereby condoned.

Misc. Case stands disposed of.
