Instant petition has been filed under Section 482 Cr.P.C. readwith Section 439 Cr.P.C. for grant of interim regular bail to the petitioner inan FIR No.197 dated 16.09.2021 under Section 21 (c) of the Narcotic Drugsand Psychotropic Substances Act, 1985 registered at Police Station SadarTohana, District Fatehabad, for a period of two weeks to attend the marriageof his brother and sister.
Counsel for the petitioner submits that the petitioner is incustody in FIR, Annexure P-l, since 16.09.2021. By referring to theMarriage Card, Annexure P-2, counsel submits that the marriage of hisbrother and sister has been fixed and functions are scheduled to be held on03.01.2022 and 04.01.2022 and the presence of the petitioner is required atthe time of the functions. Counsel has filed an affidavit of Vinod son ofKrishan Kumar, brother of the petitioner, to submit that besides the FIR,Annexure P-1, petitioner is involved in another criminal case, which hasbeen registered against him for offences under Sections 147, 149, 323 and341 IPC at Police Station Bhuna, District Fatehabad.

On asking of the Court, State counsel has sought instructions regarding the marriage in the family of the petitioner. She has also filed acommunication dated 30.12.2021 from Incharge Chowki Kula Police StationSadar, Tohana verifying the factum of marriage as well as the date ofceremonies|
Counsel for the parties have been heard.
Keeping in view the fact that the presence of the petitioner isnecessary at the time of the marriage ceremonies of his brother and sister,the petition is disposed of with a direction that the petitioner be taken to thevenue of the marriage ceremonies in the morning of 04.01.2022 underproper police custody as per rules and be brought back to the jail premises inthe evening on the same day.
