The High Court Of Madhya Pradesh

WP-13529-2020

(KUSUM BAI GONDVs THE STATE OF MADHYA PRADESH AND OTHERS)

[31][-][12][-][2020]Jabalpur, Dated :Jabalpur, Dated :

Heard through Video Conferencing.

Shri Brijesh Kumar Rajak, counsel for the petitioner.

Shri J.S.Hora, P.L for respondent/State.

With the consent, finally heard.

The corpus is produced before this court by the police authority through Video Conferencing.

Shri Hora, P.L apprised the court that as per Dakhil Kharij Register and as per Higher Secondary Certificate, the corpus is major.

Shri Brijesh Kumar Rajak did not dispute the same.

On a specific query from the Bench, the corpus stated that she is major and has solemnized marriage on her own volition. She is residing with respondent No.4 on her own volition.

Since admittedly the corpus is major and residing with respondent No.4 on her own volition, no case is made out for interference under Habeas Corpus jurisdiction.

Petition sans substance and is hereby dismissed.
