WP-22261-2015

(TULSA BAIVs THE STATE OF MADHYA PRADESH)

31-12-2015

Shri Gambhir Singh Dikshit, learned counsel for petitioner.Smt. Surbhi Nigam, learned G.A. for the respondent/State.Petitioner by way of present petition seeks direction torespondent No.3 to consider the petitioner's applicationsaid to be filed under the M.P. Land Revenue Code 1959(though there is no proof on record to substantiate thefiling of such application) and direction to the higherRevenue Authority to take disciplinary action against therespondent No.3. Petitioner also seeks direction torespondent No.3 to act and exercise his revenue powers under the Public Charter Notification dated 1st August,1997 made effective from 5th August, 2000. Petitioner alsoseeks direction to the Revenue Authority to correct theland revenue records of the petitioners as agriculturalland bearing Khasra No. 60, Patwari Halka No. 25/31Bandobast No. 305 admeasuring 0.295 hectares.

The long and short of the lis is that the Revenue Authoritybe directed to mutate the name of the petitioner. To saythe least petitioner has remedy to seek redressal of hisgrievance under Section 109/110 of the M.P. LandRevenue Code, 1959. Or to seek declaration of title overthe property in question before the Competent Court ofjurisdiction. The authority/Court concerned would be atliberty to examine the same on its merit.

However, it is made clear that this Court has notexpressed any opinion on the merits of the matter. The petition stands disposed of in above terms.C.C. as per rules.
