Plespondent

Office Note as toaction (if any)taken on Order Order with Signature Heard Mr. N. Rai, Ld. counsel assisted by6 Miss Jyoti Kharga, Ld. counsel for the petitionerand Mr. Karma Thinley, Ld. Additional PublicProsecutor.

Since the trial is at its fag end it was agreedat the very out set that the grievance of thepetitioner will be met if a time frame is rixed forconclusion of the ongoing trial.

A perusal of the copies of the different ordersheets annexed to the Bail application show thatout of the total number of 34 witnesses only 3witnesses are left to be examined. The orderdated 18.11.2006 makes it clear that the prayermade by the petitioner for grant of bail was notaccepted duly taking note of the seriousness andgravity of the offence with which accused stoodcharged and also on account of the fact that thecase was at the fag end.

In view of the above, the Ld. Special Courtis directed to make all efforts to dispose of themain case by according priority to it by the end ofApril 2007. It is needless to say that it shall beopen to the Ld. Trial Court to resort to suchcoercive steps a.s may be.permissible under thelaw so as to secure the attendance of theremaining witnesses at the earliest possible time. With the above observations this petitionstands disposed of.
