CORAM :

HON’BLE MR. JUSTICE JITENDRA KUMAR MAHESHWARI, CJ. …

Heard on I.A. No. 4 of 2021, which is an application seeking withdrawal of the Writ Petition, inter alia, contending at the Bar that the State respondents have assured the petitioner for granting the promotion, however, on the pretext of said assurance, he seeks permission to withdraw this petition with liberty to file a fresh petition, if occasion arise, by not fulfilling the assurance.

Prayer seems to be reasonable, therefore, allowed.

Accordingly, WP (C) No. 13 of 2019 stands dismissed as withdrawn with liberty to file a fresh petition on the same cause of action, if the petitioner has not been promoted by the State respondents.
