CIVIL JURISDICTION

MAC Appeal No. 05/2014

Branch Manager, National Ins.Co.Ltd.

vs.

Krishna Bdr. Chettri & Ors

BEFORE

HON’BLE MR. JUSTICE S. P. WANGDI, JUDGE

02. 02.05.2014Present :

Mr. Thupden G. Bhutia, Advocate for the Appellant.

M/s. Ajay Rathi, Sushma Pradhan, Rahul Rathi and Pema Wangmu Bhutia, Advocates for the Respondents.

-----

Mr. Thupden G. Bhutia, learned Advocate for the Appellant, submits that as per directions contained in order dated 03.04.2014, payment of 50% of the awarded sum has been deposited. A compliance report to this has been filed which may be taken on record.

Since it is an admitted position on both the sides that the amount of compensation, even after the submissions made on behalf of the appellant is to be taken as correct, will be more than 50%, i.e., Rs.4,16,000/-, the amount deposited today may be disbursed to the claimants in equal shares. It appears that the cheques have been drawn in that manner as would appear from the compliance report.

Those be handed over to the claimants.

The matter be listed on 21.05.2014 for hearing.
