W.P. (C) No. 48 of 2024

SHRI GAGAN RAI & ANR.

.... PETITIONERS

VERSUS

STATE OF SIKKIM & ORS.

.... RESPONDENTS

Date: 17.02.2025

CORAM:

HON’BLE MR. JUSTICE BHASKAR RAJ PRADHAN, J.

.……

I.A. No. 01 of 2025

1. Mr. A. Moulik, Senior Advocate for the petitioners desires, on instructions from his clients who is present in Court, to withdraw the present writ petition. He also seeks liberty to file afresh on the ground that an order is required to be passed by the Certificate Officer in the matter. If that be correct, the order of the Certificate Officer would be a fresh cause of action. If a remedy is available, it would be open for the parties to pursue the same.

2. In that view of the matter, all questions which would be open to be legitimately agitated would definitely remain open to him. Accordingly, the Writ Petition (C) No 48 of 2024 is dismissed as withdrawn. I.A. No. 01 of 2025 stands disposed.
