IN THE HIGH COURT OF SIKKIM CIVIL JURISDICTION

W.P.(C) No. 06/2014

Luktuk Gyatso vs. Union of India & Ors.

BEFORE HON’BLE THE CHIEF JUSTICE MR. JUSTICE N.K. JAIN

03. 04.04.14 Present:

M/s Zangpo Sherpa, Dewen Sharma Luitel and Doma Lepcha, Advocates for the Petitioner.

M/s Karma Thinlay, Central Govt. Advocate with Sedenla Bhutia, Thinlay Dorjee Bhutia and D.K. Siwakoti, Advocates for respondents No. 1 and 2.

M/s. S.K. Chettri and Pollin Rai, Asstt. Govt. Advocates for State-respondents No. 3 and 4.

…

Learned counsel for both the parties argued the case at length, however, during the course of arguments, learned counsel for the petitioner, in view of Counter Affidavit filed by respondents No. 1 and 2, wherein details regarding acquisition of disputed land have been given, sought permission to withdraw this writ petition with liberty to participate in the mutation proceedings and/or approach the Revenue/Competent Authorities, in respect of grievances raised in the present writ petition.

The prayer appears to be reasonable, therefore, it is allowed.

The writ petition is, accordingly, dismissed as withdrawn with liberty, as prayer for.

It is needless to mention that since the writ petition has been disposed off finally, therefore, the interim order stands vacated automatically.
