1. Heard Mr. T.K. Sangma, learned counsel, who has submitted that the applicant has preferred an appeal before this Court against the judgment dated 28.02.2022 and order of sentence of even date passed by the learned Special Judge (POCSO)/Addl. DC(J), Khliehriat in Special (POCSO) Case No. 4 of 2020 under Sections 5(1)/6 of the POCSO Act, 2012 and under Section 377 IPC, 1860. However, in the process of preferring the said appeal, a delay of 600 days has occurred for which condonation of the same is prayed for.
2. On no strong objection being raised by the State respondent, this Court is inclined to allow the prayer made. Accordingly, the delay in filing the appeal is condoned.
3. Misc. Case disposed of.
4. Registry to diarize the main appeal and list it after 4(four) weeks. In the meantime, the lower court record is directed to be produced before this Court. The appellant is also directed to prepare the paper-book with copy to the respondents.
