Ref: Civil Misc. Recall Application No. 403730 of 2017

Heard the learned counsel for the parties.

Petitioner by the instant application seeks to recall the order dated 8November 2017 passed in the present writ petition, to the extent it relatesto writ petition, bearing No. 43654 of 2016 (Sweta Yadav Versus State ofU.P. and others), which was disposed of pursuant to the order dated 8November 2017.

The writ petition (No. 43654 of 2016) questions the correctness of theanswer key relied by the Selection Board for declaring the result ofcommon written examination in respect of PGT Teacher (History).Petitioner confines her challenge to question no. 2 i.e. "Which of thefollowing institutions was the first to spread English education in India?"

It is not being disputed by learned counsel for the petitioner that on thesaid question, the Selection Board upon obtaining expert opinion asdirected by the Court awarded marks to the candidates.

It is informed by learned counsel appearing for the Selection Board thatpetitioner applied under OBC (Female) category, and secured 113/125marks, as against, the last selected OBC (Female) candidate, who obtained114/125 marks, therefore, petitioner was not declared selected. The Boardhas declared the result of the selected candidates.

On being confronted with this fact, learned counsel for the petitionerwould not dispute the marks obtained by the petitioner, upon reevaluationof her marking on the basis of expert opinion.

In the circumstances, I do not find any reason to recall the order dated 8November 2017 at this stage.

The recall application is accordingly rejected.

Order Date :- 12.1.2018Mukesh Kr.
