WP (C) NO. 374 OF 2017

Shri Kharul Islam :: Petitioner VersusState of Meghalaya & Ors.:: RespondentsDate of Order :: 20.12.2017

PRESENT

HON’BLE SHRI JUSTICE DINESH MAHESHWARI, CHIEF JUSTICE

Shri S Dey, for the petitioner. Shri H Kharmih, for the respondents.

BY THE COURT: (ORAL)

The petitioner, said to be the Secretary of the Village Employment Council [‘VEC’] of Shidakandi Village under the Selsella Block, West Garo Hills District, Meghalaya, has filed this writ petition stating grievance that proper enquiry in his relation was not conducted and then, a cryptic order was issued not even specifying as to what was found as due and recoverable from him. It is submitted that the petitioner made representations dated 03.11.2016 and 11.09.2017, which are not being attended at by the respondents.

On being queried, the learned Government Advocate is not in a position to state as to what is the amount due in the petitioner.

In the totality of facts and circumstances of the case, it does appear appropriate to dispose of this petition at this stage itself while requiring the concerned respondent to take a considered decision on the representations of the petitioner by affording him an opportunity of hearing and by way of a speaking order.

For the purpose of hearing on his representations, the petitioner may appear in the office of the Block Development Officer , Selsella C&RD Block, West Garo Hills District on 04.01.2018, who shall be expected to take a considered decision in the matter at the earliest.

Disposed of accordingly.

CHIEF JUSTICE
