Hon’ble Mr. Justice B. Bhattacharjee, Judge Appearance:

For the Petitioner/Appellant(s) : Ms. P. Agarwal, Legal Aid Counsel. For the Respondent(s) : Mr. K. Khan, AAG with Mr. A. Kharwanlang, Addl. Sr. GA. Mr. S. Sengupta, Addl. Sr. GA. For the Respondent(s) : Mr. K. Khan, AAG with Mr. A. Kharwanlang, Addl. Sr. GA. Mr. S. Sengupta, Addl. Sr. GA.

This is an application filed under Section 5 of the Limitation Act, 1963 for condonation of delay of 1279 days in preferring the appeal against the judgment and order of conviction dated 03-01-2020 and order of sentence dated 03-01-2020 passed by the learned Sessions Judge, Ri-Bhoi District, Nongpoh in Sessions Case No. 19 of 2018.

Though the applicant has averred that there is a delay of 1279 days, the office-note attached to the case record indicates a delay of period of 1309 days.

Heard learned counsels appearing for the parties.

The reasons for delay explained in the application for condonation are found to be good reasons.

Mr. K. Khan, learned AAG appearing for the State-respondent also raises no objection to the prayer for condonation of delay.

Accordingly, the period of delay in preferring the accompanying appeal is condoned.

The application stands allowed and disposed of.
