Vs.

State of Punjab and others

.. Respondent

Coram:Hon'ble Mr. Justice A.N. JindalPresent:Mr. Yogesh Goel, Advocate for the petitioner.Mr. C.S. Brar, DAG, Punjab for the respondent.

The complainant-petitioner has preferred this revision petitionagainst the order dated 8.6.2000 passed by the learned Sessions Judge,Ludhiana, vide which the accused-respondent Naresh Kumar (hereinreferred as 'the respondent') was acquitted of the charges framed againsthim, whereas, accused respondent Wazir Chand was convicted underSection 467 IPC.

Having examined the records of the case, there are no specificallegations that the respondent Naresh Kumar was party to the fraud. However, it has been urged by the learned counsel for the petitioner thatNaresh Kumar is in illegal possession of the premises in dispute and he hasset up the claim on the basis of the agreement which has already beendeclared as forged by the court. As regards respondent Wazir Chand, areport has been received on the summons sent for his service that he hasexpired.

Having scrutinized the impugned judgment, I do not find anyinfirmity in the same. As such, this revision petition is dismissed. However, the complainant could have re-course his remedy to get thepossession of the premises through civil court.
