1. The sum of Rs.6,93,461/-( Rupees six lacs ninety three thousand four hundred sixty one) which has been deposited by way of demand draft no.130795 dated 9-10-1996 in favour of the Registrar, High Court of Gujarat on 28-10-1996 towards the amount of consideration be paid to the National Building Construction Corporation Ltd.
2. The sum of Rs.2,39,877/-( Rupees two lacs thirty nine thousand eight hundred seventy seven) which has been deposited by way of demand draft no.109327 dated 30-10-1996 on 20-11-1996 in favour of the Registrar, Gujarat High Court towards interest be paid to the National Building Construction Corporation Ltd. On receipt of this amount, the original defendant-respondent herein shall see that the document as per agreement is executed and possession is handed over immediately.
3. A sum of Rs.3000/-(Rupees three thousand) has been deposited by way of demand draft no.109331
on 30-10-1996 in this court. The same amount shall be deposited with the Legal Aid Committee which shall be utilised for the purpose of disbursement of fees to the Advocates for conducting the matters entrusted by the Legal Aid Committee or by the Court.
The parties are directed to abide by the terms.
In view of the settlement, we allow the appeal. The order passed by the trial Court is quashed and set aside.
Decree in terms of compromise to be drawn.
