ORDER
The petitioner before this Court has filed this present writ petitionbeing aggrieved by the improper pay fixation done by the respondents. Thecontention of the petitioner is that he was appointed as a Pump Attendant andwas rightly fixed by the State Government in the pay scale of Rs.825-1220 asper the Circular of the State Government dated 4/9/1996. The petitioner'sgrievance before this Court is that the respondents have later on fixed him in thepay scale of Rs.750-945.
2. An identical issue has been looked into by this Court in W.P. No.452/2015. Relevant paragraph of the order passed by this Court reads asunder:- Learned counsel for the appellant has drawn our attention to the page â51 Letter No.8152, Bhopal dated 04/09/1996 of Engineer-in-Chief/PHEDepartment, Bhopal whereby the State Government after obtaining approvalfrom the Finance Department revised a pay scale from time to time, as isevident from the aforesaid letter. Relevant of the letter dated 04/09/1996 readsas under :

“जसकावेतनमान”पये 90-170 िदनांक 1.1.74 सेदेयथा।मध्य देशकाय भा रततथाआक��मकतासेवेतनपानेवालेकम चारीवेतनपुनरीि तिनयम 1984 जोमध्य देशिवत्तिवभागके मांक 525-4323 िन-1/चारिदनांक 3.3.84 “ारािकयागयाथाअ”धसूचनालागूिदनांक 1.4.82 से भावशील जसकेवेतनमान 90-170 कोवेतनमानअनुसारपुनरीि त पये 445-635 म मान्यिकयागया।मध्य देशकाय भा रततथाआक��मकतासेवेतनपानेवालेकम चारीवेतनपुनरी णिनयम 1987 जोिवत्तिवभागके ापन मांक 411-1628-87-िन-1-चारिदनांक 3.8.87 “ारािदनांक 1.1.86 सेमान्यिकयागयाहैअनुसारवेतनमान”पये 445-635 कोवेतनमान पये 775-1200 मान्यिकयागया।इसवेतनमानकोपुन: पुनरीि तकरतेह येमध्य देशकाय भा रतवेतनपुनरीि तिनयम 1990 जोिवत्तिवभागके ापन मांक 114-90-िन-1-चारजोमध्य देशराजप म िदनांक 3.5.90 को कािशतिकयाहैकोिदनांक 1.1.86 सेलागूिकयागया, केअनुसारवेतनमान पये 775-1200 कावेतनमान पये 825-1220 मान्यिकया l From the aforesaid, it is not in dispute that from 01/01/1986 pay scalewas revised to 825-15-900-20-1220. Thereafter, as per schedule of Rule-4 ofSeva Dainik-Karyabharit Tatha Akasmikta Karmchari Niyam, pay scale of 825-15-900-20-1220 was revised to 2750-70-3800-75-4400 w.e.f. 1/1/1996 thoughthe notification was issued on 26/06/1998.
In view of the aforesaid, no further approval from the FinanceDepartment as raised by the State before the Writ court is required.
Accordingly, the impugned order is partly set aside with a direction thatthe appellant was rightly granted pay scale of Rs.2750-70-3800-75-4400.
Conclusion
3. In the light of the aforesaid judgment passed in Writ Petition No.452/2015, the present Writ Petition is allowed. The impugned recovery orderedby the respondents is set aside. The petitioner shall be entitled for pay scale ofRs.825-1220 with all consequential benefits. The amount already recovered, ifany, be refunded back to the petitioner within a period of sixty days from the Aiyer (S. A. DHARMADHIKARI)JUDGE
