Manipur High Court

MC(WP(C))/356/2017 of SALAM INDIRA DEVI Vs STATE OF MANIPUR on 22 December 2017

of 2017 (Ref:- W.P. (C) No. 167 of 2016) B E F O R E HON’BLE

22-12-2017

BEFOREHON’BLE MR. JUSTICE KH. NOBIN SINGH

This is an application filed by the applicant/petitioner praying for a direction to the respondents to include the name of the applicant as an eligible person for appointment to the post of Director (Prosecution) for the purpose of maintaining a panel of recommended candidate.

According to the petitioner, one post of Director (Prosecution) is lying vacant and it is learnt that a DPC is going to be held for filling up the said post of Director (Prosecution). The case of the petitioner is that she has no objection to the person who is eligible for appointment to the post of Director (Prosecution) being considered and recommended and all that she submits is that her petitioner’s name may be considered and kept in the panel so that after retirement of the person who is likely to be recommended, the petitioner’s name can be considered without any further DPC being held in order to maintain a continuity in the post of the Director (Prosecution) for the reason that the petitioner is likely to retire in the month of May, 2018 while the other person is retiring in the month of February.

In view of the above, this application is disposed of with the direction that State respondents while holding the DPC shall consider the case of the petitioner also along with the other person who is senior to her so that the name of the petitioner be kept in the panel. It is made clear that the petitioner has no objection to the person who is senior to her being recommended and appointed as the Director (Prosecution).
