This first application under Section 439 of Criminal Pro-cedure Code, 1973 has been filed by the applicant, who is im-plicated in connection with Crime No.314/2019 registered atPolice Station Bhikangaon, District Khargone (MP) for offencepunishable under Sections 294, 323 and 307/34 of the IndianPenal Code, 1860 and also under Section 25 of the Arms Act,

1959.

After arguing for some time on the merits of the matter,learned counsel for the applicant seeks permission of thisCourt to withdraw the bail application with liberty to renew hisprayer after recording court statement of complainant injuredSawant.

Prayer allowed.

With the aforesaid liberty, Miscellaneous Criminal CaseNo.53909/2019 is dismissed as withdrawn.
