On perusal of the file, it is revealed that the appeal was filed in theyear 1977 and the same was dismissed on 21.12.2006. Thereafter, anapplication for restoration of appeal was filed on 10.8.2009. No oneappeared on behalf of the appellant on 7.12.2017 and the case wasordered to be listed after four weeks peremptorily.

Today also, no one appeared on behalf of the appellant despite thefact that the matter has been called twice. It is 2.40 P.M.

Hence, the application for restoration of appeal is dismissed indefault.
