When the case is called, Mr. SS Debnath, learned counsel appearing for the appellants represents before this Court that he wants to withdraw the present appeal since a writ petition covering the issue involved in this appeal, has already been preferred before the concerned Court and the same is yet to come up.
In view of the above submission of the learned counsel appearing for the appellants, the present appeal is dismissed as withdrawn with a liberty to pursue the writ petition before the concerned Court without there being any objection or res-judicata.
Both the parties are at liberty to make appropriate submissions and also to adduce additional evidence, if any, before the concerned Court.
With the above observation, the present appeal is dismissed as withdrawn. As a sequel, miscellaneous application(s), pending if any, shall also stand closed.
