THE HONBLE MR. JUSTICE S.C.DAS

Heard learned counsel, Mr. P. K. Pal for the appellant-applicant and learned counsel, Mr.

B. Debnath for the claimant-respondent No.1.

This is a petition under Section 5 of the Limitation Act seeking condonation of delay of29 days in preferring the connected L.A.App No.38 of 2014.

Learned counsel, Mr. Pal for the appellant-applicant prays for condoning the delaybecause the delay was not intentional.

Learned counsel, Mr. Debnath has no objection to the prayer for condonation of delay.

The respondent No.2 is just a proforma respondent and though notice has been served, the respondent No.2 remains absent.

I have gone through the petition seeking condonation and reasons assigned seem tobe satisfactory and hence, the delay of 29 days in preferring the connected appeal standscondoned.

The C. M. Application accordingly stands disposed of.
