ORAL JUDGEMENT

Heard learned advocates for the parties. Learned advocate Mr. Patel appearing for the petitioner states that the matter at issue in this petition has been decided against the petitioner by the Hon'ble Supreme Court in the matter of Ahmedabad Urban Development Authority vs. Manilal Gordhandas and Others [JT 1996(8) 646]. He, however, states that some of the land owners [not the petitioner] have made an application for review of the above judgment which is pending. He, therefore, seeks leave to withdraw this petition and states that the petitioner shall pursue the remedy available to him in the event the review application pending before the Hon'ble Supreme Court is decided in favour of the land owners. Leave is granted. The petition is disposed of as withdrawn. Rule is discharged. There shall be no order as to costs.
