1. This application has been filed by respondent no.2 for release of the awarded amount as deposited by the petitioner in compliance of order dated 15[th] October 1996.
2. Previously on 05[th] October 2005, the petition was dismissed in default. Thereafter, this application has been pending.
3. Mr. Manish Agarwal, Executive Engineer is appearing and states that he has communicated to his counterpart; however, there has been no constructive response from him.
4. Accordingly, the application of respondent no.2 is allowed.
5. The amount deposited by virtue of order dated 15[th] October 1996 in the Registry of this Court be paid to the respondent no.2 through wire transfer or Demand Draft, along with accrued interest, subject to respondent no.2 furnishing an indemnity bond in this regard, to the satisfaction of the Registrar General.
