This anticipatory bail application under Section438 Cr.P.C. has been moved seeking the bail ofapplicant-Anurudh Kumar in the event of his arrestin Case Crime No.267of 2021, under Sections 193,419, 420, 467, 468, 471 I.P.C., Police Station Bela,District Auraiya.

Heard learned counsel for the applicant, learnedA.G.A. for the State and perused the materialavailable on record.

Learned counsel for the applicant submits that theapplicant is innocent and has been falselyimplicated in the present case. The prosecutionstory is false and fake. It is further submitted thatif the applicant is enlarged on anticipatory bail, heshall not misuse the liberty of bail and would co-operate with the investigation.

Lastly, learned counsel for the applicant prayedthat a suitable direction be issued for earlydisposal of the case and his bail application, if hesurrenders before the trial court, in accordancewith law.

Learned A.G.A. has vehemently opposed the prayer for granting anticipatory bail but he has noobjection to the aforesaid request regarding thedirection of bail.

Having regard to the submissions made by learnedcounsel for the parties, allegation made againstthe applicant, I do not find any good ground torelease the applicant on anticipatory bail,therefore, prayer is refused.

However, if the applicant surrenders before theCourt concerned in aforesaid case and file bailapplication, the same shall be heard and decidedexpeditiously in accordance with law.

With the aforesaid observations, the presentapplication is disposed of.
