ORDER % 28.12.2011

W.P.(C) No.9128/2011 & CM Nos.20466/2011, 20467/2011

Vide order dated 27th April, 2011 passed in W.P.(C) No.488/2011 titled Parampreet Singh Vs. MCD & Ors., a learned Single Judge of this Court while directing de-sealing of the suit property, granted liberty to the respondent!DDA to inspect and take appropriate action in case there is any unauthorized development.

A show cause notice dated 24th June, 2011 was issued to the occupants of the property including the petitioner, who alleges to be owner/occupant of the basement and ground floor. Thereafter, an order under Section 3l(A) of the Delhi Development Act, 1957 for sealing of illegal and unauthorized construction appears to have been passed on 20th September, 2011.

Petitioner has an alternative remedy of challenging the sealing order under Section 31(C) of the Delhi Development Act, 1957 before the Appellate Tribunal. Accordingly, I am not inclined to entertain this writ petition.

Dismissed.

All other interim applications are also disposed of as in:fructuous. in:fructuous.
