HIGH COURT OF TRIPURA AGARTALA

Review Pet. No. 45 of 2021

For Petitioner(s) : Mr. RKP Singh, Adv. For Respondent(s) : Mr. K De, Addl. GA Mr. N Majumder, Adv.

HON’BLE MR. JUSTICE S. TALAPATRA

22.12.2021

Order

Mr. RKP Singh, learned counsel appears for the petitioner and Mr.

K De, learned Addl. GA appears for the respondents No.2,3 & 4 whereas Mr. N Majumder, learned counsel appears for the respondents No. 5 & 6.

Some typographical mistakes owing to inadvertence have entered in the judgment dated on 15.12.2021 delivered in WP(C) No. 193/2021.

This court having perused the averments seeking correction is satisfied that such corrections are necessary for avoiding any confusion. If the corrections are made, in no manner, the petitioner will be prejudiced.

In the 2[nd] line of the page 3 of the judgment, the following line will be deleted:

“However, Mr. RKP Singh, learned counsel appearing for the respondents No. 6, 7 & 8 has confirmed that those are not only pillars but the towers for laying the transmission lines.”

The said line will be substituted by the following line:

“Mr. RKP Singh, learned counsel appearing for the review petitioners [the respondents No. 6, 7, & 8 of the writ petition] has confirmed that for laying the transmission lines a tower has been constructed on the land of the respondent No.1 [the writ petitioner].”

In 9[th] line of the page 3 of the judgment, the words “one pillar, in addition to the tower” shall be deleted and substituted by “a tower”. Wherever the word “pillar” is appearing independently, that would submerge into the word “tower” or it will only mean “tower” for the present context.

The registry is directed to make the necessary correction in the judgment in the 2[nd] line and 9[th] line of the judgment, as indicated above, by authority of this order. Apart that, as a measure of abundant caution, this order shall form part of the judgment dated 15.12.2021 delivered in WP(C) No. 193/2021.

In terms of the above, this petition stands allowed and disposed of.

A copy of this order be supplied to the counsel for the parties.
